This study examines the protection of personal data and the right to privacy, one of the most important issues of the modern age, comparatively within the framework of the fundamental sources of Islamic law and modern legal regulations such as the European Union General Data Protection Regulation (GDPR) and the Law on the Protection of Personal Data (KVKK) in the Turkish legal system. In the face of the challenges posed by digitalization, the protection of an individual's private life has been brought back to the agenda as a constitutional and universal right. Principles found in the Qur'?n and hadiths, such as the prohibition of prying, the obligation to keep secrets, the inviolability of the home, and the protection of human dignity, clearly demonstrate that the protection of personal information in Islam is not only a legal but also a moral and religious obligation. Despite the classical fiqh literature's in-depth discussions on the protection of personal secrets, correspondence, and health data, modern legal systems have addressed the issue more on a technical and institutional level. This study compares the comprehensive approach of Islamic law to privacy, based on moral, legal, and sociocultural foundations, with the secular and technical approach of modern law, revealing that the two systems intersect on fundamental principles such as consent and transparency. Furthermore, it argues that integrating Islamic universal principles with modern legal standards, particularly in Turkey's new constitutional preparation process, could create a strong and profound constitutional guarantee for privacy and personal data.
